As the case against the Senate President, Dr Bukola Saraki, over alleged false declaration of assets took a different turn at the weekend, the Inspector General of Police, Mr. Solomon Arase has assured that he would arrest the Senate President as directed by the law before Monday.“We are going to promptly arrest the Senate President, Dr. Bukola Saraki and produce him before the Code of Conduct Tribunal on Monday. Since it is a bench warrant issued by a competent court, the order will be carried out without delay. We don’t want to pre-empt anything.”This was disclosed by new Force PRO, Mrs. Olabisi Kolawole, in an interview with LEADERSHIP.The Code of Conduct Tribunal sitting in Abuja, had on Friday, issued a bench warrant for Saraki’s arrest, for failing to appear in court over his ongoing trial for alleged false declaration of his assets. Prior to the issuance of the arrest warrant by the CCT, Saraki had approached a High Court which gave ruling faulting the process of his planned arraignment at the of Code of Conduct Tribunal (CCT).The Tribunal ordered the Inspector Generalof Police to arrest and produce the Senate President before it on Monday. The Tribunal ruled that Saraki must be available to take plea in the 13-count charge slammed on him by the Federal Government over alleged false declaration of assets.A deputy director in the office of the Attorney General of the Federation, Mr. M.S. Hassan, applied for the arrest order following Saraki’s refusal to appear before the Tribunal to enter his plea.It was stated that a Justice of the High Court lacked the powers to summon the CCT and CCB chairmen, even as it accusedSaraki of engaging in “forum shopping” in a desperate bid to scuttle his trial.The case against Saraki:The 13-count charge accused him of making anticipatory declaration of assets, false declaration of assets and maintenance of foreign account contrary to the Third Schedule of the Constitution.

Saraki Appeals Code Of Conduct Tribunal Ruling

The Senate President, Senator Bukola Saraki, has filed an appeal challenging theruling of the Code of Conduct Tribunal which ordered the Inspector-General of Police, Mr Solomon Arase, to arrest and produce him before the tribunal on Monday, September 21.In his ground of appeal, Senator Saraki through his counsel, Joseph Daudu, submitted that the tribunal erred in law and also acted without jurisdiction‎ by assuming jurisdiction over the criminal trial of the appellant at the Code of Conduct Tribunal for a charge which is being challenged at the Federal High Court.Senator Saraki, in his appeal, stated that as at the time the tribunal overruled the appellant’s application to discharge the order for bench warrant for his arrest by the respondent, there was an order of the Federal High Court which was served on the tribunal.He further submitted that the appellant filed an application‎ dated September 17, challenging the jurisdiction of the tribunal to adjudicate on the charge brought before it.The Senate President also submitted that it was trite that when an accused files an application challenging the jurisdiction of a court/tribunal to adjudicate on a charge brought before it, the accused need not bein court.The appellant therefore asked the Court ofAppeal to set aside the order of the Code of Conduct Tribunal.The Code of Conduct Tribunal had earlier ordered the arrest of the Senate President for failing to appear before the Tribunal to answer charges of alleged false declaration while he served as Governor ofKwara State between 2003 and 2007.Delivering a ruling on the suit filed by the Code of Conduct Bureau, Chairman of the Tribunal, Justice Danladi Umar ordered the Inspector-General of Police to produce the Senate President on Monday,September 21, which is the next adjourned date.The Tribunal held that no court of coordinate jurisdiction can restrain the Tribunal from performing its constitutionalduties.
